ASSUMPTION OF RISK
Inherent Risks: You acknowledge that participation in adventure travel, trekking, and activities in mountainous and remote environments (the "Activities") involves inherent and significant risks and dangers beyond those normally encountered in daily life. These risks include, but are not limited to:
* Physical exertion for which you may not be prepared.
* Falls, slips, trips on uneven, steep, rock, wet, icy, or loose terrain.
* Injuries from rocks, roots, river, scree, ice, snow, or other natural or man-made obstacles.
* Extreme weather conditions: cold, heat, rain, snow, hail, wind, lightning, fog, which can change rapidly and lead to hypothermia, hyperthermia, frostbite, dehydration.
* Altitude-related illnesses: Acute Mountain Sickness (AMS), High Altitude Cerebral Edema (HACE), High Altitude Pulmonary Edema (HAPE), which can be serious or fatal.
* Natural hazards: avalanches, rockfall, landslides, flash floods, earthquakes, volcanic activity.
* Encounters with wildlife (e.g., insects, snakes, bears, domestic animals) that may bite, sting, or cause injury or illness.
* Getting lost, separated from the group, or disoriented.
* Lack of immediate access to medical facilities, emergency services, or reliable communication, and potential delays in receiving medical attention or evacuation.
* Equipment failure or malfunction (whether your own or provided by Ramblers India or third-party operator).
* Risks associated with river crossings, rudimentary bridges, or makeshift trails.
* Illness or disease contracted from food, water, unsanitary conditions, or other participants.
* Negligence of other participants, third-party suppliers (e.g., transport, accommodation), or other individuals not under the direct control of Ramblers India or our third-party organizer.
* Accidents or illness in remote regions where rescue and medical facilities are limited or non-existent.
* Civil unrest, political instability, crime, or terrorism in the region.
Voluntary Assumption: You understand that these risks may result in serious injury, illness, disability, emotional distress, property damage, or death. You voluntarily and expressly assume all such risks, known and unknown, foreseeable and unforeseeable, inherent in participating in the Activities, however caused.
No Guarantee of Safety: You acknowledge that while the Ramblers India will take reasonable precautions to ensure safety, it is not possible to guarantee absolute safety, and the Ramblers India or the assigned team members or localguides cannot be held responsible for risks inherent in the nature of the activity.

By registering for and participating in any cycling activity organized by Ramblers India you acknowledge and accept the following terms:

Assumption of Risk - Cycling Event

Cycling involves inherent risks, including but not limited to:

  • Accidents due to terrain, weather, or road conditions

  • Collisions with vehicles, other cyclists, or obstacles

  • Equipment failure or personal injury

  • Exposure to heat, cold, dehydration, or fatigue

  • Limited access to immediate medical assistance

Equipment Responsibility

You are responsible for ensuring your bicycle is roadworthy and properly maintained. Please make sure to return the provided bicycle in the same condition as you received it. Helmets, reflective jackets and appropriate safety gear are mandatory. Ramblersindia is not liable for damage, theft, or malfunction of personal equipment.

Road Safety & Conduct

This event may take place on open public roads. You agree to:

  • Follow all traffic laws and the Highway Code

  • Ride responsibly and remain alert to surroundings

  • Remove yourself from participation if you feel unfit or unsafe
     

By registering for and participating in any rappelling activity organized by Ramblers India, you acknowledge and accept the following terms:
Assumption of Risk

Rappelling—descending a vertical or near-vertical surface using ropes and specialized gear—carries inherent risks, including but not limited to:

  • Falls, slips, or uncontrolled descents

  • Rope burn, entanglement, or harness malfunction

  • Rockfall, loose edges, or unstable anchor points

  • Environmental hazards (rain-slicked rock, wind, water currents if near waterfalls)

  • Equipment failure or misuse

  • Limited access to immediate medical assistance in remote areas

You voluntarily assume all risks associated with rappelling and understand that absolute safety cannot be guaranteed.
Health & Fitness Declaration

You confirm that you are in good physical and mental health to undertake rappelling. Please disclose any medical conditions (e.g., heart issues, back problems, allergies, medications) via the mandatory disclaimer form. If undisclosed conditions emerge that may affect safety, we reserve the right to remove you from the activity at your own expense.

Equipment Responsibility

  • Ramblers India provides certified helmets, harnesses, descender devices, and gloves.

  • You must use only the equipment issued and follow all fitting and safety instructions.

  • You are responsible for the care of personal items and gear not supplied by us. We are not liable for loss, theft, or damage to your belongings.

Conduct & Compliance

  • Follow all instructions from our certified guides without exception.

  • Wait patiently for your turn at the rappel point—rushing can endanger you and others.

  • Do not remove safety gear unless instructed; report any equipment concerns immediately to our team.

By registering for and participating in any waterfall rappelling activity organized by Ramblers India, you acknowledge and agree to the following terms:

Assumption of Risk

Waterfall rappelling involves descending through flowing water on vertical or near-vertical rock faces. These activities carry inherent risks, including but not limited to:

  • Slips, trips, or uncontrolled falls on wet, slippery surfaces

  • Rockfall, unstable ledges, or loose anchors

  • Fast-moving water currents and variable flow rates

  • Rope burn, entanglement, or hardware malfunction

  • Hypothermia or heat stress from exposure

  • Limited or delayed access to medical assistance in remote areas

You voluntarily assume all risks associated with waterfall rappelling and understand that absolute safety cannot be guaranteed.

 

Health & Fitness

You confirm that you are in good physical and mental health for this demanding activity. Please disclose any relevant medical conditions (e.g., heart issues, back problems, allergies, medications) in the mandatory disclaimer form. Failure to disclose may result in your removal from the activity at your own expense.

 

Equipment Responsibility

  • Ramblers india provides certified helmets, harnesses, descender devices, gloves, and necessary anchoring equipment.

  • You must use only issued gear, follow all fitting instructions, and report any equipment concerns immediately.

  • Bring your own sturdy, closed-toe footwear, quick-dry clothing, and a secure dry bag for valuables.

  • The Organizer is not liable for loss, theft, or damage to personal items.


By registering for and participating in any rock climbing activity organized by Ramblers India, you acknowledge and agree to the following terms:

Assumption of Risk

Rock climbing involves inherent dangers, including but not limited to:

  • Falls, slips, or uncontrolled descents on vertical or overhanging surfaces

  • Loose rock, falling debris, or unstable holds

  • Equipment malfunction or misuse (ropes, harnesses, carabiners, anchors)

  • Weather-related hazards (rain, wind, lightning, heat stress)

  • Overexertion, fatigue, or dehydration

  • Limited access to immediate medical assistance in remote or rugged terrain

You voluntarily assume all such risks and understand that absolute safety cannot be guaranteed.

 

Health & Fitness Declaration

You confirm you are in good physical and mental health to undertake rock climbing. Please disclose any medical conditions (e.g., heart issues, back problems, allergies, medications) on the disclaimer form. If undisclosed conditions emerge that may impact safety, We reserve the right to remove you from the activity at your own expense.

 

By registering for and participating in the camping event organized by Ramblers India, you acknowledge and agree to the following terms:

Assumption of Risk

Camping involves outdoor elements and remote settings that carry inherent risks, including but not limited to:

  • Unstable or uneven ground, tripping hazards, and slips

  • Rapidly changing weather (rain, wind, cold, heat)

  • Encounters with wildlife or insects (bites, stings, animal damage)

  • Campfire and cooking hazards (burns, sparks, smoke inhalation)

  • Water-related risks (nearby rivers, lakes, flash floods)

  • Illness from food, water, or environmental exposure

  • Limited or delayed access to medical facilities

You voluntarily assume all such risks and understand that absolute safety cannot be guaranteed.

 

Environmental Conduct Disclaimer:

By joining any trek or camping event organized by Ramblers India, you agree to the following environmental conduct guidelines. Failure to comply may result in removal from the activity, forfeiture of fees, and responsibility for any remediation or fines.

Leave No Trace

  • Pack out all non-biodegradable waste, including food wrappers, batteries, and hygiene products.

  • Do not bury or burn trash—carry it out to the nearest approved disposal point.

Trail & Campsite Etiquette

  • Stay strictly on marked trails and campsite boundaries to protect plant life and fragile soils.

  • Do not cut switchbacks, carve new paths, or trample vegetation.

  • Camp only in designated areas; avoid setting up tents on wetlands, or culturally sensitive sites.

Water-Source Respect

  • Nature calls at least 200 m away from streams, lakes, and other water bodies.

  • Never wash dishes or clothing directly in natural water sources.

  • Dispose of soapy water by dispersing it on durable ground away from all waterways.


Third-Party Services Disclaimer

When an activity involves venues, services, or products provided by independent third-party vendors, Ramblers India:

  • Does not endorse or guarantee the safety, accuracy, reliability, or quality of those external services.

  • Does not monitor their compliance with legal requirements, industry standards, or best practices.

  • Is not responsible for any loss, damage, injury, delay, dispute, or dissatisfaction arising from your interaction or transaction with a third-party provider.

Your use of third-party services is at your own risk. Any claims or complaints must be directed to the respective vendor, and Ramblers India will not mediate or assume liability for those services.

Environmental Conduct

  • Adhere to Leave No Trace principles: carry out all non-biodegradable waste and avoid disturbing local flora and fauna.

  • Follow your guide’s instructions at all times—rushing or horseplay can endanger yourself and others.

  • Respect local customs and property; seek permission before entering private or sensitive areas.

  • Practice Leave No Trace: pack out all trash, minimize impact on flora and fauna.

  • Stay on marked trails and respect any protected areas.
  • Use biodegradable soap at least 200 m from water sources.


By bringing a pet on any Ramblers India trek, hike, or outdoor activity, you acknowledge and agree to the following:

Owner’s Assumption of Risk

  • You understand that trekking and hiking carry inherent risks to both humans and animals (e.g., uneven terrain, wildlife encounters, weather extremes).

  • You voluntarily assume all risks associated with your pet’s participation, including injury, illness, or death.

Health, Vaccinations & Gear

  • Your pet must be up to date on all vaccinations, parasite prevention, and health checks required by local authorities.

  • You are responsible for packing and carrying all necessary pet supplies (food, water, bowl, first-aid kit, leash, harness, waste bags).

On-Trail Conduct

  • Pets must remain under your control at all times—use a secure leash or hands-free system.

  • Prevent your pet from chasing wildlife, disturbing other participants, or straying off the designated trail.

  • Clean up after your pet immediately; pack out all waste without leaving it behind.

Accommodation & Permits

  • Not all campsites or accommodation providers accept animals. You must secure pet-friendly bookings and permits in advance.

  • Additional fees or restrictions may apply for pets; you bear full responsibility for any extra costs.

Liability & Indemnification

  • To the fullest extent permitted by law, Ramblersindia and its affiliates are not liable for any harm, loss, or damage caused by or to your pet.

  • You agree to indemnify and hold harmless Ramblersindia, its guides, and agents from any claims, costs, or expenses (including legal fees) arising out of your pet’s participation.

Emergency Evacuation

  • You are solely responsible for arranging and funding any emergency veterinary care or evacuation needed by your pet.

  • Ramblersindia staff may assist in contacting services but assume no obligation or liability for pet rescue or treatment.

Severability

  • If any provision of this Disclaimer is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.

  • By allowing your pet to join a Ramblersindia activity, you confirm that you have read, understood, and accepted this Pets on Treks & Hiking Disclaimer.


PARTICIPANT RESPONSIBILITIES & ACKNOWLEDGEMENTS
Physical Fitness & Health:

  • You declare that you are in good physical and mental health appropriate for the demands of the outdoor activities. Treks/ Hikes involves strenuous physical activity, often at altitude and in variable weather conditions.

  • You must truthfully inform us of any pre-existing medical conditions (including allergies, medications, mental health conditions) in the disclaimer form that might affect your ability to participate or require special attention. Failure to disclose relevant information may result in your removal from the outdoor event at your own expense.

  • The Organizer reserves the right to decline your participation if we believe your health or fitness level is unsuitable for the trek, or if you have not disclosed a condition that could impact your or others' safety.

  • Checklist: You are responsible for bringing appropriate personal clothing and equipment as outlined in the checklist.  We are not responsible for loss or damage to your personal equipment.

Travel Documents: You are responsible for ensuring you have a valid passport, any necessary visas, and travel documents required for the destination if it is abroad.
Behavior: You agree to act in a considerate and respectful manner towards other participants, guides, local staff, local communities, and the environment. Abusive, disruptive, or illegal behavior will not be tolerated and may result in your removal from the event without refund and at your own expense.
Following Instructions: You agree to follow the instructions and guidance of our team leaders/guides at all times.
Insurance: It is a condition of booking that you have adequate travel insurance. This insurance must cover, at a minimum: emergency medical expenses, personal accident, evacuation (including helicopter rescue where appropriate for the region), repatriation, trip cancellation, and loss of baggage/personal effects. Ramblers India as a company will not be liable for any expenses incurred due to lack of or insufficient insurance.

 

Limitation of Liability

Under no circumstances will Ramblersindia, its affiliates, partners, employees, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of:

  • Your use of—or inability to use—this website or its content

  • Participation in any Organizer-arranged activity

  • Reliance on any information, advice, or recommendations provided

This limitation applies even if Ramblersindia has been advised of the possibility of such damages.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNIFICATION AGREEMENT
In consideration for being permitted to participate in the activity, you, on behalf of yourself, your personal representatives, heirs, executors, administrators, agents, and assigns, hereby:
release, waive, discharge, and covenant not to sue us, its directors, officers, employees, team leaders, trip leaders, trek leaders, sherpas. porters, local guides, volunteers, agents, contractors, successors, and assigns (collectively "the releasees") from any and all liability, claims, demands, actions, causes of action, losses, damages, costs, or expenses (including attorneys' fees) of any kind whatsoever, which you, your heirs, executors, administrators, or assigns may have or may hereafter have, arising out of or relating to any loss, damage, injury, illness, or death to person or property, whether caused by the negligence of the releasees or otherwise, while participating in the trekking, cycling, caming, climbing or any related outdoor activities.
Agree to indemnify and hold harmless the releasees from any and all liabilities, claims, demands, losses, damages, costs, or expenses (including attorneys' fees) incurred by the releasees as a result of your participation in the activity, or as a result of any claims made by you, or on your behalf, or by your family, estate, heirs, or assigns, even if such liabilities are caused in whole or in part by the negligence of the releasees.
You understand that this release of liability means you are giving up, among other things, your right to sue the releasees for injuries, damages, or losses you may incur. you also understand that this agreement is binding on your heirs, executors, administrators, and assigns.

MEDICAL AUTHORIZATION & EXPENSES

Our team carries first-aid kits and has established evacuation procedures. However, waterfall sites can be remote and access may be challenging. You agree that Ramblersindia is not responsible for delays in medical treatment or transport.

  • You authorize us and our representatives to secure any medical treatment deemed necessary for your health and safety during the trek. This may include first aid, administration of medication, or arranging for evacuation.

  • You agree to be fully responsible for all costs and expenses associated with any such medical treatment, evacuation, or repatriation, and you agree to reimburse the party for any such costs incurred on your behalf.


ITINERARY CHANGES & FLEXIBILITY

  • The Participant acknowledges that outdoor activity like trekking/ camping in remote and mountainous regions requires significant flexibility. The outlined itinerary is an aim and may be subject to alteration due to (but not limited to) weather conditions, trail conditions, participant ability/health, guide's discretion for safety, local governing bodies, political instability, logistical problems, or other unforeseen circumstances.

  • Ramblers India and its guides reserve the right to make changes to the itinerary as deemed necessary for the safety and well-being of the group. No refunds will be provided for minor changes. If significant alterations are necessary that materially change the nature of the trek, we will endeavor to offer suitable alternatives based.

  • Our team leader/guide has absolute authority to make decisions in the field, including decisions affecting the itinerary or your continued participation if they believe your health, safety, or behavior could be detrimental to yourself, other participants, or the success of the trek.​


PHOTOGRAPHY AND MEDIA

  • We may take photographs or videos of participants during the activity. You grant us the irrevocable, royalty-free, worldwide, perpetual right and license to use your image, likeness, voice, and name in any photographs, videos, or other media taken during the event for promotional, marketing, or any other lawful purposes, without compensation to you.

  • If you do not wish for your image or likeness to be used, you must inform the us in writing prior to the event departure.


FORCE MAJEURE

  • The Organizer will not be liable for any failure or delay in performance of its obligations under these Terms & Conditions if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, insurrection, governmental actions, travel advisories, strikes, labor disputes, pandemics, epidemics, natural disasters (earthquakes, floods, fires, volcanic eruptions, extreme weather), or any other cause beyond the Organizer's reasonable control ("Force Majeure Event").

  • In the event of a Force Majeure Event, we may, at its sole discretion, cancel, modify, or suspend the activity. Refunds, if any, in such circumstances will be at the Organizer's discretion, considering any unrecoverable costs incurred. A credit towards a future event may be offered.
     

PRIVACY

The Organizer will collect and use your personal information for the purpose of organizing and administering the trek. We will handle your personal data in accordance with our Privacy Policy

SEVERABILITY

If any provision or part of a provision of these Disclaimer is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable, or illegal, the other provisions shall remain in full force and continue to apply without interruption

ENTIRE AGREEMENT
These Terms & Conditions, along with any booking forms and pre-event information shared by Ramblersindia, form the complete and binding agreement between you (the participant) and Ramblersindia (the Organizer). This agreement replaces all previous communications, discussions, or understandings—whether written or verbal—related to your participation in the activity.


EXTERNAL LINKS DISCLAIMER

Our website may include links to external websites, content, or services provided by third parties. These links are shared for convenience, but Ramblersindia does not investigate, monitor, or verify the accuracy, reliability, or completeness of third-party content.
