ASSUMPTION OF RISK
Inherent Risks: You acknowledge that participation in adventure travel, trekking, and activities in mountainous and remote environments (the "Activities") involves inherent and significant risks and dangers beyond those normally encountered in daily life. These risks include, but are not limited to:
* Physical exertion for which you may not be prepared.
* Falls, slips, trips on uneven, steep, wet, icy, or loose terrain.
* Injuries from rocks, roots, scree, ice, snow, or other natural or man-made obstacles.
* Extreme weather conditions: cold, heat, rain, snow, hail, wind, lightning, fog, which can change rapidly and lead to hypothermia, hyperthermia, frostbite, dehydration.
* Altitude-related illnesses: Acute Mountain Sickness (AMS), High Altitude Cerebral Edema (HACE), High Altitude Pulmonary Edema (HAPE), which can be serious or fatal.
* Natural hazards: avalanches, rockfall, landslides, flash floods, earthquakes, volcanic activity.
* Encounters with wildlife (e.g., insects, snakes, bears, domestic animals) that may bite, sting, or cause injury or illness.
* Getting lost, separated from the group, or disoriented.
* Lack of immediate access to medical facilities, emergency services, or reliable communication, and potential delays in receiving medical attention or evacuation.
* Equipment failure or malfunction (whether your own or provided by the Organizer).
* Risks associated with river crossings, rudimentary bridges, or makeshift trails.
* Illness or disease contracted from food, water, unsanitary conditions, or other participants.
* Negligence of other participants, third-party suppliers (e.g., transport, accommodation), or other individuals not under the direct control of the Organizer.
* Accidents or illness in remote regions where rescue and medical facilities are limited or non-existent.
* Civil unrest, political instability, crime, or terrorism in the region.
Voluntary Assumption: You understand that these risks may result in serious injury, illness, disability, emotional distress, property damage, or death. You voluntarily and expressly assume all such risks, known and unknown, foreseeable and unforeseeable, inherent in participating in the Activities, however caused.
No Guarantee of Safety: You acknowledge that while the Organizer will take reasonable precautions to ensure safety, it is not possible to guarantee absolute safety, and the Organizer cannot be held responsible for risks inherent in the nature of the activity.
PARTICIPANT RESPONSIBILITIES & ACKNOWLEDGEMENTS
Physical Fitness & Health:

You declare that you are in good physical and mental health appropriate for the demands of this trek. This trek involves strenuous physical activity, often at altitude and in variable weather conditions.

You must truthfully inform the Organizer of any pre-existing medical conditions (including allergies, medications, mental health conditions) that might affect your ability to participate or require special attention. Failure to disclose relevant information may result in your removal from the trek at your own expense.

The Organizer reserves the right to decline your participation if we believe your health or fitness level is unsuitable for the trek, or if you have not disclosed a condition that could impact your or others' safety.

Equipment: You are responsible for bringing appropriate personal clothing and equipment as outlined in the trek's packing list (to be provided by the Organizer). The Organizer is not responsible for loss or damage to your personal equipment.
Travel Documents: You are responsible for ensuring you have a valid passport, any necessary visas, and travel documents required for the trek destination.
Behavior: You agree to act in a considerate and respectful manner towards other participants, guides, local staff, local communities, and the environment. Abusive, disruptive, or illegal behavior will not be tolerated and may result in your removal from the trek without refund and at your own expense.
Following Instructions: You agree to follow the lawful instructions and guidance of the trek leader/guides at all times.
Insurance: It is a condition of booking that you have adequate travel insurance. This insurance MUST cover, at a minimum: emergency medical expenses, personal accident, evacuation (including helicopter rescue where appropriate for the region), repatriation, trip cancellation, and loss of baggage/personal effects. You must provide proof of insurance to the Organizer before the trek departure. The Organizer will not be liable for any expenses incurred due to lack of or insufficient insurance.
RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNIFICATION AGREEMENT
In consideration for being permitted to participate in the trek, you, on behalf of yourself, your personal representatives, heirs, executors, administrators, agents, and assigns, hereby:
RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Organizer, its directors, officers, employees, guides, volunteers, agents, contractors, successors, and assigns (collectively "the Releasees") from any and all liability, claims, demands, actions, causes of action, losses, damages, costs, or expenses (including attorneys' fees) of any kind whatsoever, which you, your heirs, executors, administrators, or assigns may have or may hereafter have, arising out of or relating to any loss, damage, injury, illness, or death to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, while participating in the trek or any related activities.
AGREE TO INDEMNIFY AND HOLD HARMLESS the Releasees from any and all liabilities, claims, demands, losses, damages, costs, or expenses (including attorneys' fees) incurred by the Releasees as a result of your participation in the trek, or as a result of any claims made by you, or on your behalf, or by your family, estate, heirs, or assigns, even if such liabilities are caused in whole or in part by the negligence of the Releasees.
You understand that this release of liability means you are giving up, among other things, your right to sue the Releasees for injuries, damages, or losses you may incur. You also understand that this agreement is binding on your heirs, executors, administrators, and assigns.
MEDICAL AUTHORIZATION & EXPENSES

You authorize the Organizer and its representatives to secure any medical treatment deemed necessary for your health and safety during the trek. This may include first aid, administration of medication, or arranging for evacuation (including by helicopter if deemed necessary).

You agree to be fully responsible for all costs and expenses associated with any such medical treatment, evacuation, or repatriation, and you agree to reimburse the Organizer for any such costs incurred on your behalf.
ITINERARY CHANGES & FLEXIBILITY

The Participant acknowledges that trekking in remote and mountainous regions requires significant flexibility. The outlined itinerary is an aim and may be subject to alteration due to (but not limited to) weather conditions, trail conditions, participant ability/health, guide's discretion for safety, political instability, logistical problems, or other unforeseen circumstances.

The Organizer and its guides reserve the right to make changes to the itinerary as deemed necessary for the safety and well-being of the group. No refunds will be provided for minor changes. If significant alterations are necessary that materially change the nature of the trek, we will endeavor to offer suitable alternatives.

The trek leader/guide has absolute authority to make decisions in the field, including decisions affecting the itinerary or your continued participation if they believe your health, safety, or behavior could be detrimental to yourself, other participants, or the success of the trek.​
PHOTOGRAPHY AND MEDIA

The Organizer may take photographs or videos of participants during the trek. You grant the Organizer the irrevocable, royalty-free, worldwide, perpetual right and license to use your image, likeness, voice, and name in any photographs, videos, or other media taken during the trek for promotional, marketing, or any other lawful purposes, without compensation to you.

If you do not wish for your image or likeness to be used, you must inform the Organizer in writing prior to the trek departure.
FORCE MAJEURE

The Organizer will not be liable for any failure or delay in performance of its obligations under these Terms & Conditions if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, insurrection, governmental actions, travel advisories, strikes, labor disputes, pandemics, epidemics, natural disasters (earthquakes, floods, fires, volcanic eruptions, extreme weather), or any other cause beyond the Organizer's reasonable control ("Force Majeure Event").

In the event of a Force Majeure Event, the Organizer may, at its sole discretion, cancel, modify, or suspend the trek. Refunds, if any, in such circumstances will be at the Organizer's discretion, considering any unrecoverable costs incurred. A credit towards a future trek may be offered.
PRIVACY
The Organizer will collect and use your personal information for the purpose of organizing and administering the trek. We will handle your personal data in accordance with our Privacy Policy

SEVERABILITY
If any provision or part of a provision of these Terms & Conditions is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable, or illegal, the other provisions shall remain in full force and effect.

ENTIRE AGREEMENT
These Terms & Conditions, along with any booking form and pre-trek information provided by the Organizer, constitute the entire agreement between you and the Organizer concerning your participation in the trek and supersede all prior communications, negotiations, and agreements, whether oral or written.
EXTERNAL LINKS DISCLAIMER
The Site may contain (or you may be sent through the Site) links to other websites or content belonging to or originating from third parties or links to websites and features. Such external links are not investigated, monitored, or checked for accuracy, adequacy, validity, reliability, availability or completeness by us.
WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OFFERED BY THIRD-PARTY WEBSITES LINKED THROUGH THE SITE OR ANY WEBSITE OR FEATURE LINKED IN ANY BANNER OR OTHER ADVERTISING.
